Bombay High Court Establishment

Today's Day in History August 14, 1862 : Bombay High Court was established for Maharashtra, Goa, Dadra and Nagar Haveli and Daman and Diu territory. This court has benches at Nagpur, Panaji and Aurangabad. In 1668, King Charles II of England leased the seven islands of Bombay that he had received as dowry from his Portuguese wife, to the East India Company for 10 pounds per annum. Back then, Bombay was little more than a really small outpost with a deep harbour. To facilitate the smooth running of the territory, a law and legislation office was set up in 1672 by Gerald Aungier, the second Governor of Bombay. As the city prospered over the next 200 years, there was a need for a larger legal set-up. And so, through the grant of 'Letters Patent' by Queen Victoria in 1862, three High Courts were set up - in Bombay, Calcutta and Madras. Not many are aware that it was at the Bombay HC where barristers like Mahatma Gandhi, Sardar Patel, BR Ambedkar & Jinnah practised the law.

Criminal law is set into motion as soon as an FIR is lodged u/s 154 of the Cr.P.C. Practically before lodging an FIR, the crime spot is visited the police men who are informed about the happening of the alleged crime. Upon lodging an FIR the police gets into the process of arresting the accused. After the accused is arrested, he produced before the "NEAREST MAGISTRATE" who then decides whether the accused has to be a given a bail or be kept in police custody or sent to judicial custody. After the investigation is completed, the police files a report before the magistrate u/s 173 of the Cr.P.C., this report is commonly called the "POLICE REPORT. It contains: 1) name of the parties involved. 2) the facts of the complaint 3) versions of the complaints and the accused 4) statements of the witness, evidence gathered in the course of investigation, medical reports, reports by various agencies etc and any other necessary information gathered during investigation. "Indian Marriages" in the context of dowry related violence

Vismaya Nair.  The recent  death   of 24-year-old medical student Vismaya Nair in the Indian state of Kerala has sparked widespread outrage and renewed discussions over  dowries   and domestic violence in India. Despite their illegality, dowries are largely seen as a source of pride and status among families on both sides. The dark underbelly of the practice includes discrimination against girls, femicide, abuse and endless violence against brides in the country. Vismaya’s death renewed the   clamour  for a permanent solution that would end the harmful practice. Dowry In India Unravelling the murky  origins  of dowry in India  is not easy . Dowries are essentially a payment made by the bride’s family in cash or goods in exchange for marriage. Women are expected to relinquish their  rights to inheritance or property  in exchange for a dowry, which many women are forced to accept because of family loyalty and fear of disputes. Women who refuse to offer a dowry often cannot wed and c

Death for Love

A neesh and his wife Deepti Everyday there is a news of honour killing in India. Couples are being killing for intercaste marriage, marriage outside religion, marriage without approval in the name of honour killing. Lack of governmental action to stop honor killings comes up for criticism even as the crime continues unabated.  In the latest such incident, caste-based violence against people from marginalised caste communities has come to headlines from Uttar Pradesh. Aneesh Kumar Chaudhary, a Gram Panchayat officer from the Dalit community was murdered on July 24 allegedly by people from the Brahmin caste community in Gorakhpur district, the home of CM Yogi Adityanath. Aneesh had recently got married to his colleague Deepti Mishra who comes from the Brahmin community against the latter’s family who opposed their marriage vehemently in the name of caste pride. Deepti and Aneesh’s family members have accused Deepti’s natal family of murdering him. Aneesh and Deepti
