A case of terrible sins in a family

 Today I am going to narrate you a true story of a case that I witnessed in the Latur Juvenile Court.  Since last seven months I have been working with the District Legal Services Authority in Latur.  My duty is handling cases at juvenile court, CJM, jmfc and visiting prisoners at Latur District Jail.

On 20th January 2024 it was around 01:40 pm. I was going to have my lunch when I received a phone call from the juvenile court. A juvenile was apprehended by police on the allegations of rape on his own minor sister. I reached the juvenile court and met juvenile's mother. The case was of incestuous relationship of two minor brother and sister.  I could see a desparate mother trying to save his son who committed terrible sins.  

A 14 year old girl was hospitalized in Government Hospital by her mother. Doctor found victim 7 months pregnant and asked mother whether she is married, to which mother replied she is not married. Pregnancy was almost matured and few months were remained for delivery.  Doctor asked mother to inform to the police.  Mother registered FIR against unknown person of committing rape on her minor daughter and impregnating her. And crime was registered under section 376, 376(2)n of IPC and u/s 4 and 8 of Pocso Act.  Victim did not reveal anything about this incident before the police. She didn't name the person who did this acts with her.  Two months later, victim was delivered and gave birth to a baby. Soon after birth, baby was given to a "Shushu Grah". Some days later baby was also dead.  

Two months after the delivery of victim, father asked his son whether he did this with his sister and son confessed to the father that he has committed a mistake and responsible for this.  Then father produced him before police station and then police produced him before the Juvenile Justice Board. Complainant was mother of both victim and the accused (CCL).  Victim and juvenile both were real brother and sister.  

During interrogation he narrated the story with me.  He told me that he was watching a romantic movie and after watching a romantic scene he had sex with his sister. I asked him, "Didn't she resisted you?" He said, "she didn't do anything." Girl was innocent 14 year old child and she may not have idea of what she was allowing to do.  Juvenile was also only 17 years old and after watching movie committed this incestuous relationship with his real sister. Relations continued for months and victim become pregnant.  This was shocking for family and may have lead to a great humiliation in the society.  

To me it feels sad about the victim girl as mother blamed all to her alone. Her schooling was stopped.  Both parents were more worried about the son than daughter.  It is also shocking why mother could not have realised that victim daughter have no periods for months. As per medical jurisprudence, pregnancy is clearly visible after 4-5 months.  Why mother could not have noticed her daughter's pregnancy till her hospitalisation?  I could only see her desparate attempts to save son from the law. 

I have filed bail application for the CCL.  It is pending for the say of PO.  He may get bail after some days but the question still remains what will be the future of victim girl? Will the brother and sister talk as brother and sister as before?  What will she suffer mentally after all this?  Even after release will son live in the same house were the victim lives? 

Uncontrolled sexual desires in man committed terrible sins.

Does caste change after marriage?

* A woman’s caste does not change after marriage. Caste is determined by birth. By default , the father’s caste is the child's caste. Marriage does not alter the caste of someone. So, OBC lady cannot become a SC just because she married a SC male. However, the children of them will belong to SC as the father is a SC. However, there are certain exception in case child of such wedlock ( father UR but mother Reserved) who is raised in reserved community and separated or absence of father presence, he may be treated reserved as per mother caste. There are many exceptions : 1. When orphan child is adopted by mother of reserve caste. 2. When generation of Indian father of reserve caste live outside of India ( with no caste system) and when grand children return to India which caste they will be.

What is the difference between 'sin' and 'offence' ?

Sin is an immoral, bad, unethical and unlawful thing in the eyes of society.  Offence is an unlawful and illegal act or omission which is punishable by the law.  Adultery, prostitution, sex before marriage, eating animals these some of things are considered as sin in the Indian society. But sin is not punishable by the law. The man who commits sin is responsible to the god.  Murder, rape, bigamy, theft, violation of traffic rules these are the some offences. These offences are punishable by law with capital punishment, imprisonment or by fine.  Sin is not a crime. The role of police and judge starts when sin becomes an offence. When it's a sin, it can not be questioned. Police and judge can not take cognizance of sin. A person responsible for sin is answerable before the Supreme Lord of the universe on the day of judgement.
