Who are real dacoits?


Certain castes have been cursed and regarded as criminal tribes in India.  They have been persecuted for centuries.  They wander from one place to another place for living. Their pain is unheard by the society. No one has any sympathy or kindness towards them.  They are ignored and humiliated on time to time.  The one such tribe in Maharashtra is "Paradhi" (पारधी). They have presence in Maharashtra's rural area especially in Marathwada region of Maharashtra.  

The story I am going to tell you is of Krishna and his brother Ravi. Krishna was working as a labourer in a factory in Aurangabad. His brother has a small Tum Tum.  A day ago, Krishna came to Udgir to see his new born baby who is just one month old.  Somewhere in the jurisdiction of Wadhvana police station a robbery happened and Krishna and his brother Ravi were picked up by the Local Crime Branch in Latur.  Both of them were beaten till the blood come out of their mouth. They were crying with pain and saying they are innocent. Police did not inform them their crime.  Police were just asking to tell them where is the stolen property of which they know nothing.  The men with stone hearts can not listen poor and innocent peoples voices.  The superior powers of the state are looters and real dacoits. 

Balika is sister of Krishna and Ravi.  She made several attempts to get information about why her brothers been arrested. No one was co-operating with her.  By crying her eyes were gone into deep. Helplessness was clearly visible on her face. 

Balika came to the office of Legal Aid Defence Counsel in Latur and narrated the incident to me. I immediately went to the office of Local Crime Branch in Latur and introduced myself to the Inspector.  I introduced myself as a government advocate and then inspector asked me to take a seat.  Krishna and his brother Ravi were arrested on mere suspension. Their arrest was illegal detention as 24 hours were passed and they were not produced before any magistrate.  I told inspector if they are not named in any crime then they should be released otherwise your actions will term as unlawful detention of the innocents.  Inspector had no good opinion of these two innocent men. He was saying these men are criminal and their gang have made many robberies in the district. I told inspector to produce before any magistrate or release them.  Finally inspector agreed to hand over them to Wadhwana police station and i got back to my office.  I told Balika and her other relatives to go back to their home and call me if they are not produced before the magistrate till tomorrow afternoon. 

I have seen several incidents where local crime branch officers recover stolen goods from accused but whatever they have recovered only half or little is shown as a recovery especially when the stolen goods is money or gold. Once I went to the police station to get the copy FIR registered against my client. I was very new to this profession.  PSI had asked me for Rs 10,000/-.  It was urgent and I had no other option and so I gave Rs 500 to him unwillingly. In other case, a thief stole some 50 thousands rupees from the donation box of a temple in Latur.  Police recovered all the stolen money from thief but he show recovery only Rs 9000/-.  My experience says police is the most corrupt institution in india.  There is urgent need of reorganization and transformation of police institution in India.  

I don't know what will happen with Krishna and Ravi.  I don't know how long they will remain in unlawful detention of the police.  These tribes have been cursed to suffer injustice for perpetual.  India has got freedom in 1947 but the Paradhi's (पारधी) are still not free.  They are in jail on false cases of Theft, Robbery and Dacoity.

Does caste change after marriage?

* A woman’s caste does not change after marriage. Caste is determined by birth. By default , the father’s caste is the child's caste. Marriage does not alter the caste of someone. So, OBC lady cannot become a SC just because she married a SC male. However, the children of them will belong to SC as the father is a SC. However, there are certain exception in case child of such wedlock ( father UR but mother Reserved) who is raised in reserved community and separated or absence of father presence, he may be treated reserved as per mother caste. There are many exceptions : 1. When orphan child is adopted by mother of reserve caste. 2. When generation of Indian father of reserve caste live outside of India ( with no caste system) and when grand children return to India which caste they will be.

What is the difference between 'sin' and 'offence' ?

Sin is an immoral, bad, unethical and unlawful thing in the eyes of society.  Offence is an unlawful and illegal act or omission which is punishable by the law.  Adultery, prostitution, sex before marriage, eating animals these some of things are considered as sin in the Indian society. But sin is not punishable by the law. The man who commits sin is responsible to the god.  Murder, rape, bigamy, theft, violation of traffic rules these are the some offences. These offences are punishable by law with capital punishment, imprisonment or by fine.  Sin is not a crime. The role of police and judge starts when sin becomes an offence. When it's a sin, it can not be questioned. Police and judge can not take cognizance of sin. A person responsible for sin is answerable before the Supreme Lord of the universe on the day of judgement.
